Terms of service

By commission our studio, you agree to the following terms and conditions.

Before we start

> Fiverr buyer should follow the rules on fiverr.

> All payments outside fiverr are to be made in full and upfront in USD via Paypal or using cryptocurrency, unless otherwise specified.
‍
> Once an invoice has been sent, the payment must be submitted within 3 days. The commission will be terminated should the payment not be made by the date specified.
‍
> After discussing with us for the detail of the project, payment for invoices would be made and payment must made by the within 3 days with a screenshot of prove. Failure to do so will result in the termination of commission.

During Commssion

> For every project, we follow the same process of work :
1. Provide coloured sketches (with watermark)
2. Ask for approval and revisions.
3. Proceed to finalise the artwork.
4. Deliver finalised render with watermark.
5. Ask for approval and revisions.
6. Deliver final file.
----------------------------------For Vtuber rigging packages-----------------------------------
5a. Proceed to rigging.
5b. Deliver preview video with watermark.
5c. Ask for approval and revisions.
5d. Deliver final project file.

* Once the project passes step 2, we do not accept any "GO BACK" revisions with any reasons. Meaning that, we would not revise the any part of the artwork that has been approved. Client might need to pay extra for any revisions like that.

> Studio Nekoyama would contact the client via telegram / Email / Discord / Fiverr to report the progress check.

> Client should remain communicative throughout the process to ensure that progress can be completed before deliverable date. If the client provide a non-communicative stand within the duration of 10 days, the project will be terminated with no refunds.

> The client will be responsible to make extra payments for revisions that are beyond the scope of the original commission that has been mutually agreed on.

After Commssion

> Client must properly identify Studio Nekoyama as the creators of the commission (by crediting Studio Nekoyama in social media descriptions).

> Studio Nekoyama reserves the right to display the commission in their portfolio unless confidentiality is requested for a certain period of time. ( unless otherwise specified )

> The commission would be closed 7 days after the mutual approval of the final deliver. Any additional revisions requested during the 7 days will be considered by our team.

The selection of an artist and rigger for a project is determined by their availability and the client's budget. A client who wishes to specifically choose an artist or rigger, may incur additional fees and potentially experience longer wait times.

Studio Nekoyama would contact the client via telegram / Email / Discord / Fiverr to report the progress of work.

Client should remain communicative throughout the process to ensure that progress can be completed before deliverable date. If the client provide a non-communicative stand within the duration of 10 days, the project will be terminated with no refunds.

The client will be responsible to make extra payments for revisions that are beyond the scope of the original commission that has been mutually agreed on.

6. Deliver final file.

For Vtuber rigging packages

6a. Proceed to rigging.
6b. Deliver preview video with watermark.
6c. Ask for approval and revisions.
6d. Deliver final model file.

*No Live2D source files(e.g. cmo3 files) would be delivered.

After commission

Client must properly identify Studio Nekoyama as the creators of the commission (by crediting Studio Nekoyama in social media descriptions).

Studio Nekoyama reserves the right to display the work in our portfolio unless confidentiality is requested for a certain period of time. (unless otherwise specified)

The commission would be closed 7 days after the mutual approval of the final deliver. Any additional revisions requested during the 7 days will be considered by our team.

We cannot guarantee revisions/adjustments after the 7 days period, or any future upgrades including but not limited to new outfits/hair etc. as unforeseeable incidents might happen. (eg. resignation of artists/riggers)

Clients should always backup all the deliveries.

Reservation of rights

Client cannot use commissioned work for AI-generated derivative works.

Our Studio products come with a default Commercial License for commercial use.

The Standard Commercial License allows promotional use on social media and streaming platforms, but modifications require written permission.

Deliverables remain the intellectual property of Studio Nekoyama and are non-transferrable.

An Extended Commercial License adds a fee of 40% to 200% and permits digital and physical merchandise production.

Refund and cancelation

The client can terminate the agreement anytime by sending a written notice to Studio Nekoyama. Compensation is as follows:

- No work done:
Refunding the client 100% of the total payment.
‍
- Partial work done:
‍Client would need to compensates artist/s 25% to 75% of the total payment based on progress.
‍
- Full work done:
Client compensates artist/s in full as per the contract.
